1. Agreement

By accessing the Sebiu Labs website (sebiulabs.co.uk) or downloading, installing, or using any software provided by Sebiu Labs ("we", "us", "our"), a trading name of EventSwitcher Ltd, you agree to be bound by these Terms of Use. If you do not agree, do not use our website or software.

These terms should be read alongside our End User Licence Agreement, Privacy Policy, and Cookie Policy.

4. Free Software Licence

We grant you a non-exclusive, non-transferable, revocable licence to download and use our Free Products for your own professional or personal purposes, at no charge. Free Products are provided without a licence key and may be used indefinitely.

Free Products are provided on an "as is" basis. We do not guarantee availability of support, updates, or continued development. However, nothing in these terms affects your statutory rights under the Consumer Rights Act 2015.

5. Paid Software and 30-Day Trial

Paid Products include a 30-day free Trial Period with full functionality. The Trial Period begins on the date you first install or run the software. No payment or Licence Key is required during the Trial Period.

When the Trial Period expires, you must purchase a Licence Key to continue using the software. If you do not purchase a licence, the software will cease to function or revert to limited functionality.

Licence Keys are validated via Keygen.sh. Your software will periodically contact Keygen.sh to verify your licence status. An internet connection is required for initial activation and periodic validation.

6. Payment Terms

Payments for Paid Products are processed by Stripe. By making a purchase, you also agree to Stripe's Terms of Service.

7. Refund and Cancellation

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day cooling-off period from the date of purchase during which you may cancel and receive a full refund.

However, for digital content (software downloads), you may waive this cooling-off period by giving express consent to begin the download immediately and acknowledging that you lose your right to cancel. If you provide this consent at the point of purchase, no refund is available once the download begins.

If you have not waived your cancellation right and wish to cancel, contact us at contact@sebiulabs.co.uk within 14 days of purchase. We will process your refund and revoke your Licence Key.

These refund terms do not affect your statutory rights under the Consumer Rights Act 2015. If the software is faulty or not as described, you are entitled to a repair, replacement, or refund regardless of the above.

9. Updates and Modifications

We may release updates, patches, or new versions of our Software from time to time. Updates may be delivered automatically or require manual installation, depending on the product.

In accordance with the Consumer Rights Act 2015, we will ensure that any updates to Paid Products maintain the software's conformity with the contract. We will not push updates that materially reduce functionality without reasonable notice.

Updates to Free Products and Paid Products during an active licence period are provided at no additional charge.

Lifetime (perpetual) licences include one year of updates from the date of purchase. After the update period ends, the software continues to work indefinitely on the installed version. To receive newer releases, you may purchase an update renewal.

We are not responsible for the availability, security, or performance of third-party services. If a third-party service outage prevents licence validation, we will work to resolve the issue as quickly as possible but accept no liability for any resulting downtime.

All software, source code, content, trademarks, logos, and materials on our Website and in our products are owned by EventSwitcher Ltd or its licensors. Nothing in these terms grants you any rights to our intellectual property beyond the limited licences described herein.

"Sebiu Labs", "OMT Monitor", "OMT VCam", "Echo Lab", "EchoStream", and related product names are trading names or trademarks of EventSwitcher Ltd.

13. Disclaimer of Warranty

Free Products are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Paid Products are provided in accordance with the Consumer Rights Act 2015. Digital content must be of satisfactory quality, fit for a particular purpose, and as described. Your statutory rights are not affected by these terms.

We do not warrant that any Software will be error-free, uninterrupted, or compatible with all hardware or software configurations.

14. Limitation of Liability

Nothing in these terms excludes or limits our liability for:

Subject to the above, our total liability to you in connection with Paid Products shall not exceed the total amount you have paid us for the relevant product in the 12 months preceding the claim.

Subject to the above, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, whether incurred directly or indirectly.

15. Termination

We may terminate or suspend your licence and access to our Software immediately if:

Upon termination, you must immediately cease using the Software and delete all copies from your devices. Termination does not affect any rights or obligations that accrued before the termination date.

You may terminate your licence at any time by uninstalling the Software and deleting all copies. Termination by you does not entitle you to a refund except as described in section 7.

16. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via our Website or by email to registered users. The "Last updated" date at the top of this page indicates when the most recent changes were made.

Your continued use of our Software or Website after changes are posted constitutes acceptance of the updated terms. If you do not agree with the changes, you should stop using our Software and Website.

17. Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remainder of these terms, which shall continue in full force and effect.

18. Entire Agreement

These terms, together with the EULA, Privacy Policy, and Cookie Policy, constitute the entire agreement between you and EventSwitcher Ltd regarding your use of our Website and Software.

19. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, internet outages, third-party service failures, government actions, or industrial disputes.

20. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in these terms affects your statutory rights as a consumer under English law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
